When two power-driven heavier-than-air aircraft are converging at approximately the same altitude,

Why this is the answer

Per CAR 602.19(2), the aircraft that has the other on its right must give way; therefore the aircraft on the right has the right of way. Two power-driven aircraft are equal in the hierarchy, so position decides.
